ONLINE SALES STANDARD TERMS AND CONDITIONS - EURO FASHION RETAIL

These Standard Terms and Conditions of Sale govern the sales of EMPREINTE L’ATELIER LINGERIE items on the web site by: EUROFASHION RETAIL, a simplified joint-stock company (une société par actions simplifiée = a form of simplified limited company under French law) with 220,000 euros capital, based in Brest 29200 – 5 rue de l’Eau Blanche, represented for the purposes hereof by the company, acting as Chair, itself represented by its Chair, Mr Philippe Berthaux, registered with the trade and companies register under the number 503 432 098. Intra-community VAT number: FR 01 503 432 098.

The act of placing an order implies full acceptance of these Standard Terms and Conditions of Sale which can be accessed on the web site at all times and in particular when the order is being registered. We would suggest that you print off and keep a copy of these Standard Terms and Conditions of Sale for all future reference. Unless it is proven otherwise, the data recorded by us shall provide proof of the transactions and their date.

The Standard Terms and Conditions of Sale shall constitute the only agreement between the parties and shall have precedence over any other document. They may be altered at any time. The new Standard Terms and Conditions of Sale shall apply to any order that is placed after the new Terms are made available on the web site.

Orders can only be placed on the web site by individuals who are “end buyers”. Any buyer seeking to trade professionally, by selling on EMPREINTE L’ATELIER LINGERIE items, is strictly prohibited from doing so.

CLAUSE 1 – ITEMS FOR SALE ON OUR WEB SITE

Lingerie and swimsuits from the brand Empreinte with or without the option of customized bras, knickers and items of lingerie. Customised items are non-returnable and therefore not subject to a refund. Items in the swimsuit range cannot be customized.

CLAUSE 2 – ITEM UNIT PRICES AND THE TOTAL ORDER AMOUNT
The prices of the items are inclusive of all tax (20% on January 1st 2014), and exclude transport costs. Prices are given in euros.

The prices can be altered at any time, it being understood that items are invoiced based on the prices that apply when the order is registered.

The total amount for the order that you want to place is shown on your order’s “Order summary” screen, and in particular it shall include the following information: the price, inclusive of all tax, for the item(s) and for each customization option.

CLAUSE 3 – ORDERS

This website offers you the possibility of ordering non personalized and personalized items.
Your Empreinte size
This stage is vital. Please take the necessary time and care to take the measurements correctly. Make sure that you use a measuring tape to take your measurements.   

We recommend that you get someone to help you with this stage. 
A video entitled "Check my size" will guide you in your measurement.
- Measurements should be taken whilst you are wearing your bra. 
- Measure below the bust ensuring that the tape is tight. 
- Measure around the bust with the tape at the cleavage.   

CUSTOMISATION
Customised items cannot be returned or refunded. We recommend that you give the creation of your garment the necessary time and attention.   
To customise your garment, please click on and then place your chosen embellishment in the desired position. The 3 areas in grey are available for customization.   
You can alter any decisions made by clicking on the embellishment in question and moving it away from the area.    Only items of lingerie, bras and knickers can be customised.  

EMBROIDERY
Only bras can be embroidered. 2 areas are available for embroidery: the back and the right side. Enter the desired message and/or initials and select the colour and style of script for the embroidery. The colour is used on the 2 areas of embroidery.

CLAUSE 4 – PAYMENT

When placing your order you can pay for your purchases by credit card only. Only Visa and Mastercard are accepted. As soon as your payment is authorized, you shall be sent an email from: paiement@empreintelatelierlingerie.com
The amount shall be debited from your credit card a maximum of six (6) days after your order is placed, in the currency of your card. The purchases you make online are completely secure. A secure environment (SSL protocol) guarantees the confidentiality of the bank details that you send online to a registered bank via the web site.

The numbers for the credit card used to make the payment are kept on a bank’s secure web site and not on our own web site.
As part of our electronic payment system and to counteract fraudulent use of payment methods on the Internet, we shall check the reliability of any information you enter while registering your order. We also reserve the right to request additional documents (a photocopy of your identity card, proof of address etc,) to authorize your purchase and dispatch your parcels. These requests shall be made either over the telephone or by email. Until the price of the order, the VAT and all transport costs have been fully paid, we shall retain ownership of the items sold.

CLAUSE 5 – DELIVERY – DESTINATION

The items offered for sale shall only be delivered within mainland France, this includes Corsica. Your delivery shall be made to the address you provide when placing your order. We shall not deliver to a registered EMPREINTE point of sale, to an EMPREINTE shop, a PO Box, an address marked “military postal facility”. We shall insure the items until they are delivered.

5.1. DELIVERY – TRANSPORT COSTS
You have 2 delivery choices:
CHRONOPOST: 
Registered delivery
Delivery time in France: D+1, before 1 pm. Only if Only if your order is placed before 12am on non personalized items.
Deliveries are made by Chronopost Monday to Friday. Email and SMS alerts available Amount: €24 (tax already included)

SO COLISSIMO - WITHOUT an arranged a pick-up
Delivery time in France: 2 days to 4 days. Deliveries are made by SoColissimo Monday to Saturday.
Email and SMS alerts available
Order inferior at 150€, amount: €9 (tax already included)
Order superior at 150€, Empreinte ‘Atelier Lingerie’ will deliver for free

5.2. DELIVERY – DELIVERY TIMES
Once your order has been received, it will be processed within 48 hours. We require 10 days to process your order for customized items. The time taken to deliver your order needs to be added to this and varies depending on the delivery method selected. The average delivery period is 4 days.

You have not received your order in the time stated:
> If you have received an email confirming dispatch, but you have not received your order in the time stated please contact our Online Shopping Customer Support Service: contact@empreintelatelierlingerie.com   

> If you have not received an email confirming dispatch, but 3 weeks have passed since the date shown on the email confirming your order, please contact our Online Shopping Customer Support Service: contact@empreintelatelierlingerie.com   

> You have received a shipment confirmation by email but you have not received your order within 7 days after the delivery date has passed for any other reason other than force majeure:  You can, if you wish, cancel the order (by recorded mail with a return receipt requested under the conditions stipulated in article L121-20-3 of the Consumer Code).   

You can exercise this right if a delay of 60 working days from the scheduled delivery date occurs. Nevertheless, we ask you to please contact our Online Shopping Customer Support Service immediately. contact@empreintelatelierlingerie.com. After verification, this service will tell you the options available for the return of your item(s). You will be refunded all amounts paid (including delivery charges paid when the order for the product(s) concerned was placed) in a maximum of 15 days from the date when you exercised your right.    

5.3. DELIVERY – TAKING DELIVERY OF THE GOODS
5.3.1. PRECAUTIONS
To avoid any complications arising when you take delivery of your parcel we would ask you to read the following information carefully: For any order delivered in mainland France (including Corsica), the delivery company shall hand the parcel over to the recipient named on the consignment note, after it has been signed for. If there is nobody to receive the parcel, and unless technically unfeasible for the delivery company, you shall receive an attempted delivery notice giving details of the post office from which you will have 14 days to collect your parcel, you will need to provide proof of identity.

5.3.2. RESERVATIONS
Once you take delivery of your order, please check the condition of your parcel and that the item ordered is as it should be and that the customization conforms with your order. If you see that your parcel or your item has been damaged, we would ask you to detail this on the delivery company’s delivery note, and to contact our Online Shopping Customer Service Department immediately: contact@empreintelatelierlingerie.com . In your message, please ensure that you describe the damage (the parcel is damp, opened, has holes, etc.). In any case, from when you receive your parcel you have a three (3) day period, excluding bank holidays, to inform the delivery company of any reservations you may have, by an extrajudicial document1 or a recorded delivery letter (article L133-3 of the French Consumer Code). If the item(s) delivered is/are not what you ordered, you may return them, in accordance with the “Returns” and “Guarantees” procedures set out below.

CLAUSE 6 – RETURNS

6.1. MADE-TO-MEASURE ITEMS
Given the unique and customized nature of made-to-measure items, in accordance with article L121-20-2 of the French Consumer Code they cannot be taken back or exchanged: “The right of withdrawal cannot be exercised unless the parties have agreed otherwise, for contracts: (…) 3° The supply of goods made to the customer’s specifications or clearly personalized …”. This means that you have no power to put forward any right of withdrawal. We would therefore recommend that you devote ample time and care when creating your customized item.

CLAUSE 7 –RETURNS

How to make a return
We hope that you will be satisfied with your purchase at www.empreintelatelierlingerie.com. However, you can make your returns up to 15 days from the date of delivery.  

Only non-customized items can be returned.

Procedure
Empreinte ‘Atelier Lingerie’ only refunds non-customized items. . We do not exchange returned items 
 
a. Complete the returns slip included in the parcel and enclose it together with your returned items. Make sure that you keep a copy for your own personal records.  

b. Prepare your parcel and stick the pre-paid return label securely to the packaging.  

c. Take your parcel to a post office or to a So Colissimo or Chronopost pick-up point (depending on the delivery option you selected when ordering your items) and have your proof of postage stamped.    

Conditions
Only non-customized items can be returned.  

Non-customized items must be returned in perfect condition, with labels attached, unused and unwashed and in their original packaging (gift box and/or zipped pouch). Empreinte ‘Atelier Lingerie’ reserves the right to refuse a refund if the item does not fulfill all these conditions.   Refund period Refund will be made within eight (8) days of your parcel being received using the same payment method that was used for the initial purchase. The amount that was initially invoiced for the returned product will be refunded. Delivery charges for your order will not be refunded unless the item was faulty. Incomplete, altered, spoiled, damaged and/or dirty items will not be refunded and will be returned to you.    

CLAUSE 8 – GUARANTEES – AFTER SALES SERVICE – LIABILITY

8.1. LEGAL GUARANTEES
THE EMPREINTE GUARANTEE

The items on offer are in accordance with the regulations in force. They benefit from the skills, expertise and quality provided by the EMPREINTE ‘Atelier Lingerie’.   
As a result, they are guaranteed not to have any manufacturing faults. If such a fault occurs, EMPREINTE ‘Atelier Lingerie’ undertakes to repair your purchase for free, or to exchange it. When an exchange takes place, faulty items are not returned.   

The EMPREINTE ‘Atelier Lingerie’ guarantee does not cover normal wear and tear or accidental damage, or damage caused by a washing powder or abnormal use of the garment. Our customised products should only be washed by hand. Machine washing harms our products and so is not included in the EMPREINTE ‘Atelier Lingerie’ guarantee.

8.2. AFTER SALES SERVICE
The EMPREINTE l’Atelier Lingerie After Sales Service shall look after any repairs to your items arising from wear and tear, as well as any repairs connected with the application of Legal Guarantees and the EMPREINTE Guarantee. We would ask you to contact our After Sales Service by email at the following address: contact@empreintelatelierlingerie.com.

8.3. LIABILITY
We are not liable for any possible “screen/real life” difference in colour or for customization choices for the made-to-measure item that might not suit. The screen preview for your embroidery detail that you can see when you finish creating your product and the screen preview on the various screens and documents is given by way of illustration and is therefore not contractual.
Furthermore, we shall not be deemed to be liable or at fault for any delay or failure to deliver due to circumstances of force majeure beyond our control. Finally, we would like to point out that we cannot be held liable for any orders placed by a minor, regardless of whether the parents have given their permision or not for the order to be placed.

CLAUSE 9 – DOCUMENT STORAGE

For all orders above 120 euros inclusive of all tax, we undertake to keep all the documentation relating to the transaction for a period of 10 consecutive years. You are guaranteed access to this at any time should you request it.

CLAUSE 10 – FREEDOM OF INFORMATION

Your personal data, which we need to process your order, shall never at any time be sold, offered for sale or leased out to third parties. You are entitled to access, modify, correct and delete any information that concerns you: droitdacces@empreintelatelierlingerie.com

CLAUSE 11 – INTELLECTUAL PROPRERTY

The intellectual property rights for the web site and all the elements it comprises (trademarks, models, copyright, domain names etc...) are covered by ownership rights and exclusive rights of use that benefit EMPREINTE l’Atelier Lingerie alone. Any reproduction in whole or in part of the web site, without EMPREINTE l’Atelier Lingerie’s express agreement is forbidden, except for personal and private use, excluding all commercial use.

CLAUSE 12 – APPLICABLE LAW – DISPUTES

These Standard Terms and Conditions of Sale, the order and any acts that arise from them, are governed by French law. Should a dispute arise and if it cannot be resolved out of court, French courts shall have sole jurisdiction.
